The assessment report condition

In force 13 July 2026Schedule 1 item 5, amending subsection 11(4) of the 2017 PrinciplesLast updated: 2026-10-21

From 13 July 2026 subsection 11(4) requires the assessment report to support the approval of the premises for the kinds of service and the category covered by the application, with no in-principle alternative.

What the provision does

Item 5 omits "in principle" from subsection 11(4). The subsection says that, apart from exceptional cases, an approval may be given only where the Minister is satisfied that the assessment report backs approving the premises as an accredited pathology laboratory for the kinds of services and the category in the application. The amendment removes the reference to an in-principle approval. The requirement that the report support the actual approval, for the actual scope, remains.

Why it matters

This is the provision that turns the report into a condition of the approval. It also ties the report to the scope. A report that supports a narrower or different scope does not satisfy the subsection. The amendment removes any suggestion that a report could support a preliminary approval and leave the final scope to be settled later.

What changed, and when

Item 5 commenced on 13 July 2026. It is one of the eight in-principle items. The requirement that the report support the actual approval, for the actual scope, remains.

This unit is one of the ten that commenced on 13 July 2026. It is not waiting for 1 July 2027. A record that treats it as future will describe the wrong approval process or the wrong edition at the next assessment.

What to do about it

Read the report against the application line by line. Check the kinds of service, the category and any conditions or limitations. If the report is older than the assessment cycle allows, ask the independent body whether it is still the most recent report. Record the reconciliation. Where the report does not support the scope, amend the application rather than argue the point in the decision.

What the assessor asks for

Evidence a NATA assessor commonly samples for this provision.
CategoryArtefact to have ready
ReportThe most recent assessment report, with its date and the scope it covers
ReconciliationA line-by-line table that matches the report scope to the application scope
ConditionsA record of any condition or limitation in the report and how the application deals with it
Currency checkThe date the report was confirmed as the most recent report for the premises

The question that follows. A reviewer may ask whether the report supports the exact scope applied for, and a file with two different scope descriptions cannot show it.

Gaps that lose a file

  • A report that covers a different category
  • An application that widened after the report
  • Ignoring a condition in the report
  • No record of the report date

Before the date

  • Reconcile the scope before lodging
  • Ask the independent body about currency
  • Record conditions and how they are met
